For two years, the retiree submitted repeated representations to his department heads, receiving no reply or clearance. With his personal savings running out, he filed a petition before the Allahabad High Court in 2018 seeking the release of his dues.

However, court backlogs meant his plea sat without an effective hearing for years, leaving the elderly worker without income or legal relief. He eventually filed an appeal before the Supreme Court.

Supreme Court Demands Accountability and Officer Compensation

Taking a strong view of the state’s inaction, a bench comprising Justice K.V. Viswanathan and Justice Arun Palli observed that withholding retiral dues from a Class-IV worker for a decade constitutes a severe violation of basic rights.

The bench directed the Chief Secretary of Uttar Pradesh to submit a detailed report by 31 December 2026, explaining why the pension papers were not cleared immediately after retirement and naming the officers responsible for the delay at every stage. The court also asked the government to detail the disciplinary action proposed against defaulting staff and explain how it plans to compensate the retiree for his hardship.

To prevent similar delays for other low-income workers, the apex court ordered the state government to issue a formal Standard Operating Procedure ensuring pension papers for eligible employees are processed without a single day's delay upon superannuation.

Priority Hearing Sought for Pending Pension Cases

Recognising the wider administrative problem faced by senior citizens struggling to receive retiral benefits, the Supreme Court sent a copy of its order to the Registrar of the Allahabad High Court to be placed before the Chief Justice.

The bench requested the Chief Justice to examine whether cases concerning the non-release of pension benefits can be prioritised for early disposal across the state judiciary.

Although the government released the primary arrears under judicial pressure, the Supreme Court will monitor the Chief Secretary’s officer accountability report, disciplinary proceedings, and compensation framework when the case comes up for its next hearing on 4 January 2027.
